new with out tags. perfect jeans from a great brand. it's literally like going to madewell and buying there, except you'll be saving a ton. I have lots of jeans by them and they are the absolute best. there is a reason why they are so expensive, because they really are made well. they do stretch so will fit a 24. I go up and down with my weight, I just never worn when I could fit in them
